1. About these terms

These terms govern your use of the Tommy's Mexican Restaurant & Bar website (tommysdining.com.au) and any services accessed through it, including reservations, gift cards, and enquiries. By using this site you accept these terms.

2. Reservations

  • Reservations are processed through SevenRooms and are subject to availability.
  • For groups of 8 or more, a discretionary 10% service fee applies.
  • Late arrival of more than 15 minutes may result in your table being released.
  • Cancellations should be made via your booking confirmation email at least 24 hours before your reservation.
  • No-shows for large group bookings (8+) may incur a per-person fee as disclosed at the time of booking.
  • A 15% surcharge applies to all bills on public holidays.

3. Menu & pricing

  • Menu items and prices are subject to change without notice.
  • Dietary information is provided as a guide. While we make every effort to accommodate allergies, our kitchen handles nuts, gluten, dairy, shellfish and other allergens. We cannot guarantee any dish is 100% free of allergens.
  • Please inform your server of allergies or intolerances at the time of ordering.

4. Gift cards

  • Gift cards are valid for 3 years from the date of issue, in line with NSW law.
  • Gift cards are not redeemable for cash and cannot be replaced if lost or stolen.
  • Gift cards can be redeemed in-venue at our Darlinghurst location only.
  • Any unused balance after redemption remains on the card until expiry.
  • Gift cards do not cover the 15% public-holiday surcharge or discretionary service charge.

5. Functions & private events

  • Function bookings are subject to a separate function agreement that will be provided at the time of confirmation.
  • Minimum spend, deposit and cancellation terms vary by package and will be disclosed before confirmation.
  • Full venue hire, courtyard hire and banquet packages are subject to availability.

6. Behaviour & service

  • We reserve the right to refuse service or ask any patron to leave if their behaviour is unsafe, disrespectful, or in breach of our liquor licence.
  • Patrons must be 18+ to consume alcohol. Valid photo ID is required if requested.
  • We operate a Responsible Service of Alcohol policy and may refuse to serve at our discretion.

7. Website use

  • All content on this site (logo, photos, copy, menu structure) is owned by Tommy's Mexican Restaurant & Bar or used with permission. You may not copy, reproduce or redistribute it without our written consent.
  • We use cookies and analytics — see our Privacy Policy for detail.
  • External links are provided for convenience; we are not responsible for the content of third-party websites.

8. Liability

To the extent permitted by Australian Consumer Law, Tommy's Mexican Restaurant & Bar is not liable for any indirect or consequential loss arising from use of this website or our services. Nothing in these terms excludes rights you have under the Australian Consumer Law that cannot be excluded.

9. Governing law

These terms are governed by the laws of New South Wales, Australia, and any disputes are subject to the exclusive jurisdiction of the NSW courts.

10. Changes

We may update these terms from time to time. The "Last updated" date at the top will reflect changes.
